Oshkosh OWI Attorney
Drunk driving charges are probably one of the most common types of charge people can face in Oshkosh and the rest of Wisconsin. You cannot go it alone against these charges, but we’re here to help.
We are Hammett, Bellin & Oswald, LLC, a group of Oshkosh OWI lawyers who understand not just the law in Wisconsin but the people we defend. We’ve defended our clients in and out of court since 1997. We see the people we work with as neighbors in addition to clients, and we put your needs front and center in your defense.
Penalties For OWI Charges
Drunk driving is a complex group of charges that carry different consequences based on the exact circumstances of your charge. These circumstances can include whether there was a
refusal to participate in blood alcohol testing, it is a repeat offense, whether a minor was present in the vehicle or whether an injury was caused. Here are a few of the most common offenses we’ve defended:
- First-offense OWI: Fines are between $150 and $300, there is a potential six to nine-month license revocation, and there is no jail time sentence.
- Repeat offense OWI: The second and third offenses are classified as misdemeanors, and the penalties can reach up to $2000 with a potential for up to one year in jail and two to three-year license revocation.
- Felony OWI: Felony OWI starts at the fourth offense and goes to the 10th offense and beyond. The penalties are a maximum of five years, a $10,000 fine and two to three years of license revocation maximum for a fourth offense and 15 years, $50,000 and three years of license revocation for the 10th offense and beyond.
- Injury or homicide with OWI: Any injury is six years, a $10,000 fine and one to two years of license revocation; great bodily harm is 12.5 years, a $25,000 fine and two years of license revocation; and homicide is 25 years, a $100,000 fine and five years of license revocation upon release.
The consequences for all drunk driving offenses are doubled in most cases if there is a minor under the age of 16 in the vehicle at the time. But despite how dire the consequences are, you are not without hope when you work with us.
Defensive Options For OWI Charges
We can be aggressive in defending you from challenging blood draws, breath tests and officer protocol, especially from charges stemming from OWI stops on I-41, U.S. 45 and around the UW-Oshkosh campus. We will go to court and help you during the 10-day DMV hearing window to protect your driving privileges.
We will help you make a plan to deal with all of the possible consequences, including driver’s license penalties and jail. This help includes possibilities of work release privileges and electronic monitoring instead of jail time.
